By accessing or using ProMax Team, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.
1. Definitions
- "Service" refers to the ProMax Team construction management platform, including all features, tools, and functionalities.
- "We," "Us," "Our" refers to Brixel LTD, the operator of ProMax Team.
- "You," "User," "Customer" refers to the individual or company accessing or using the Service.
- "Account" refers to your registered user account on ProMax Team.
- "Content" refers to any data, information, documents, or materials uploaded to the Service.
2. Acceptance of Terms
By creating an account, accessing, or using ProMax Team, you acknowledge that:
- You have read and understood these Terms and Conditions
- You agree to be bound by these terms and our Privacy Policy
- You are at least 18 years old and legally capable of entering into binding contracts
- If registering on behalf of a company, you have authority to bind that company to these terms
3. Account Registration and Security

Account Responsibility

4. Subscription and Payment
Subscription Plans
ProMax Team offers various subscription plans with different features and pricing. By subscribing, you agree to:
- Pay all applicable fees for your chosen plan
- Provide valid payment information
- Authorize us to charge your payment method for recurring fees
- Pay all applicable taxes
Billing and Renewals
- Subscriptions automatically renew at the end of each billing cycle
- Fees are non-refundable except as required by law
- We may change pricing with 30 days' notice to existing subscribers
- You can cancel your subscription at any time; service continues until the end of the billing period
Free Trial
If you sign up for a free trial:
- The trial period duration will be specified during signup
- You will not be charged during the trial period
- Unless cancelled, your subscription will automatically convert to a paid plan
- One free trial per customer
5. Acceptable Use Policy
You agree NOT to use ProMax Team to:
- Violate any laws, regulations, or third-party rights
- Upload malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with the proper functioning of the Service
- Harass, abuse, or harm other users
- Use automated scripts or bots without our permission
- Reverse engineer, decompile, or attempt to extract source code
- Resell or redistribute the Service without authorization
- Remove copyright notices or proprietary markings
6. Your Content and Data
Ownership
You retain all rights to the content and data you upload to ProMax Team. You grant us a license to:
- Store and process your content to provide the Service
- Back up your data for security and disaster recovery
- Create anonymized, aggregated statistics for service improvement
Responsibility
You are responsible for:
- The accuracy and legality of content you upload
- Ensuring you have rights to upload and share the content
- Maintaining backups of your important data
- Complying with data protection laws applicable to your data
Data Backup
While we perform regular backups, you should maintain your own backups of critical data. We are not liable for data loss except as required by law.
7. Intellectual Property
ProMax Team and all related trademarks, logos, and service marks are owned by Brixel LTD. You may not:

- Copy, modify, or create derivative works of our platform
- Claim ownership of any part of the Service
8. Service Availability and Support
Uptime
We strive to provide reliable service with minimal downtime. However, we do not guarantee:
- 100% uptime or uninterrupted access
- Error-free or bug-free operation
- That the Service will meet all your specific requirements
Maintenance
We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without notice.
Support
Support availability depends on your subscription plan:
- Email support for all paid plans
- Priority support for premium plans
- Support hours: 24/7 for critical issues
9. Termination
By You
You may terminate your account at any time by:
- Cancelling your subscription through account settings
- Contacting our support team
Upon cancellation, you will have access until the end of your billing period. No refunds for partial periods.
By Us
We may suspend or terminate your account if:
- You violate these Terms and Conditions
- Your payment fails and is not resolved
- You engage in fraudulent or illegal activities
- Required by law or government request
Data Retention After Termination
After termination:
- You have 30 days to export your data
- We may delete your data after 90 days
- Some data may be retained for legal compliance
10. Disclaimers and Limitations of Liability
Service "As Is"
ProMax Team is provided "as is" without warranties of any kind, express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy or reliability of information
Limitation of Liability
To the maximum extent permitted by law, Brixel LTD shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from your use or inability to use the Service
- Total liability exceeding the amount paid by you in the 12 months prior to the claim
11. Indemnification
You agree to indemnify and hold harmless Brixel LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any law or third-party rights
- Your use of the Service
- Content you upload or share through the Service

Continued use of the Service after changes constitutes acceptance of the modified terms.
